THE FOLLOWING TERMS AND CONDITIONS APPLY TO USERS, VIEWERS AND ALL PEOPLE WHO HAVE ACCESS TO www.jamesonwhiskey.com (THIS “SITE”). BY USING OR VIEWING THIS SITE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SITE. ANY ACCESS OR USE OF THIS WEBSITE IS UNDERTAKEN AT THE USER’S OWN RISK.

This site is operated by Irish Distillers International Limited a private company registered in Ireland with company number 15558 and having its registered office at Simmonscourt House, Simmonscourt Road, Ballsbridge, Dublin 4, Ireland and its affiliates (“IDIL” or “We”). YOU MUST BE OF LEGAL DRINKING AGE IN YOUR COUNTRY OF RESIDENCE TO USE THIS SITE. IF YOU ARE NOT, DO NOT ENTER THIS SITE. RESTRICTIONS ON USE. Access to this Site is permitted on a temporary basis and we reserve the right to withdraw, suspend or amend the services we provide on the Site without notice. This Site changes and is updated regularly and IDIL will not be liable if for any reason the Site or any materials on it are unavailable at any time or for any period. Material from this Site may not be modified, copied, reproduced, distributed, republished, uploaded, posted, or transmitted in any way without the prior written consent of IDIL. IDIL is the owner or licensee of all intellectual property rights in the Site and in material published on it. All such rights are reserved. Neither title nor intellectual property rights are transferred to you by use of or access to this Site; rather, all rights, title and interest in and to all aspects of the Site remain the property of IDIL. Material on this Site is provided for lawful purposes only.

RESTRICTION OF LIABILITY. To the extent permitted by law, under no circumstances shall IDIL be liable for any loss or damages whatsoever (including, but not limited to direct, incidental, consequential, or indirect loss, including lost profits, loss of income or revenue, loss of goodwill, business interruption or loss of data or information or special or punitive damages, even if IDIL was notified in advance of the potential of such loss or damages), harm, or injury howsoever arising, and whether caused by tort, breach of contract or otherwise, that relate to, arise out of, or result from the use of, or access to, or the inability to use the Site, any of the materials of this Site or sites linked to this Site, or are caused by any failure of performance, error, omission, interruption, defect, delay in operational transmission, computer virus or line failure. Nothing in these Terms and Conditions excludes IDIL’s liability for death or personal injury arising from its negligence, nor its liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any liability which cannot be excluded or limited under applicable law.

IDIL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS THAT THE USE OF THIS SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT THE CONTENTS WILL BE CORRECT, ACCURATE OR RELIABLE, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IDIL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS AND EXPRESSLY DISCLAIMS ALL LIABILITY AND RESPONSIBILITY REGARDING USE OF OR RELIANCE UPON INFORMATION CONTAINED IN THIS SITE IN TERMS OF ITS ACCURACY, RELIABILITY OR OTHERWISE. YOU (AND NOT IDIL) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

SUBMISSIONS. By submitting any remarks, suggestions, questions, ideas, creative concepts, graphics, or other information (collectively the “Submission”), you agree to grant IDIL a non-exclusive licence to use that Submission. Although you will still own the copyright in your Submission, IDIL will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Submission. This licence will be free of charge, perpetual and capable of sub-licence. IDIL will not be required to treat the Submission as confidential and will not be liable for any use whatsoever or disclosure of the Submission and need not provide any compensation or acknowledgement for the Submission. IDIL may exercise all copyright and publicity rights in the material contained in your Submission in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material. You must ensure that your Submission does not infringe any copyright, database right, trade mark or other intellectual property right of any other person and that it does not contain any unlawful, threatening, libellous, defamatory, obscene, pornographic or profane material that could constitute or encourage criminal or unlawful conduct or would tend to encourage or promote irresponsible alcohol consumption (collectively the “Inappropriate Material”). By submitting your Submission, you are warranting that you have the right to grant IDIL the non-exclusive copyright licence described above and that it does not contain any Inappropriate Material. If you are not in a position to grant such a licence or to warrant that it does not contain Inappropriate Material, please do not submit the Submission. IDIL reserves the right to alter or amend any Submission prior to publication (if any) so that any Inappropriate Material is deleted.

JURISDICTION. This agreement shall be governed in accordance with the laws of Ireland, notwithstanding any principles of conflicts of law. Any dispute arising from these Terms and Conditions will be submitted to the exclusive jurisdiction of the Irish courts, although this does not affect IDIL’s right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. Except as described otherwise, all materials in this Site are made available only to provide information about IDIL and its products. IDIL controls and operates this Site from the Republic of Ireland and makes no representation that these materials are appropriate or available for use in other locations.

TRADEMARK INFORMATION. All trademarks and all related logos, designs, labels, bottle designs and all other intellectual property associated with IDIL’s products and brands used herein are owned by Irish Distillers International Ltd. – a list of those trademarks can be obtained from the Internet Manager, Irish Distillers International Ltd. Simmonscourt House, Simmonscourt Road, Ballsbridge, Dublin 4, Ireland. The use or misuse of these trademarks or any content of this Site, except as provided above, is strictly prohibited. All other trademarks are the property of the respective trademark owners.

INFORMATION ABOUT YOU AND YOUR VISIT TO THE SITE. IDIL processes information about you in accordance with its Privacy Statement, which is available here. By using the Site, you consent to such processing and you warrant that all information provided by you is accurate and up to date.

MISCELLANEOUS. Products and promotions of IDIL are produced and available in many parts of the world. However, this Site may describe products, promotions or contests that are not available in your country or state of domicile. This Site may be linked with other sites and IDIL is not responsible for the content of those sites. IDIL can revise these Terms and Conditions or the content of the Site at any time by updating this posting. CONSUMER COMPETITION TERMS AND CONDITIONS

  1. Information on how to enter and prizes forms part of these conditions. By participating, entrants agree to be bound by these conditions.  Entries must comply with these conditions to be valid. For the avoidance of doubt the above Schedule to these Terms & Conditions forms part of these conditions. 
  1. Entry is open to Eligible Entrants.  The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion; and any retailer activating the promotion are ineligible to enter the promotion.  
  1. To enter the promotion, Eligible Entrants must complete the Entry Mechanism during the Promotion Period. 
  1. If applicable, the Entry Limit applies to entries. Any excess or invalid entries will be deemed invalid. 
  1. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid.  Entries must be submitted in the manner required and received by the Promoter during the Promotional Period. Entries received will be considered final by the Promoter. Late entries will not be accepted. 
  1. The Promotion Period commences at the Commencement Time on the Commencement Date and closes at the Close Time on the Close Date. The random draw selection will take place at the Nominated Business on the Draw Date. 
  1. If the entrant’s entry is deemed invalid, the Promoter will award the Prize to the next randomly drawn entry, drawn at the same time and place as the original Draw Date and repeat this process until the prize is awarded to an Eligible Entrant. 
  1. The Prize must be taken as offered and cannot be varied by the winner(s). Prizes are not transferable or exchangeable and cannot be taken as cash. Any change in the value of a prize between the advertising date and the date the prize is claimed is not the responsibility of the Promoter. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  
  1. The winner(s) will be notified by the Approved Notification Method.  

 

  1. Prizes will be delivered to winners by the Prize Delivery Method by the Prize Delivery Date. The Promoter and its agents associated with this promotion take no responsibility for a prize (or part of a prize) damaged or lost in transit (if relevant).  
  1. The Promoter encourages the responsible use of prize(s), in accordance with applicable legislation.  
  1. If for any reason a Prize, or any part of a Prize becomes unavailable for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute the Prize (or part thereof) for an alternative Prize to the same or greater value of the original Prize value, subject to applicable law. 
  1. Entrants must only enter in their own name. The Promoter reserves the right to request the winner(s) to produce (within a nominated time period) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, residency and/or eligibility to enter and/or claim a prize and any information submitted by the entrant in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that entrant’s entry will become invalid. Proof of identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. The prize(s) will only be awarded following any validation and verification of the entrant that the Promoter requires in its sole discretion. In the event that an entrant cannot provide suitable proof, the relevant prize will be forfeited and no substitute will be offered as the entrant will be disqualified. 
  1. Where applicable, the Promoter reserves the right to refuse to allow the Prize winner or any of their companions to take part in any or all aspects of the Prize if the Promoter determines, in its absolute discretion, that the Prize winner (or any of their companions where applicable) are not in the mental or physical condition necessary to be able to safely participate in or use the Prize. 
  1. No compensation will be payable if a winner (or their companions if applicable) are unable to use any element of a Prize for whatever reason, including refusal of entry or ejection from the location(s) or participation in certain activities for health, age, behaviour or safety reasons.  Any part of a Prize that is not taken for any reason is forfeited and will not be substituted. 
  1. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their Prize within the Claim Days, the 

 

Promoter may instead offer the prize to the next Eligible Entrant selected from the valid entries that were received before the Closing Date. 

  1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. 
  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion,  the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 
  1. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to entrant’s or any other person’s mobile handset,  computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion. 
  1. Entry and continued participation in this promotion is subject to the Promoter’s licensing obligations and liquor serving policy where applicable. 
  1. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 
  1. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.  
  1. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.   
  1. Any attempt to deliberately undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs. 
  1. As a condition of entering this promotion, the winner(s) agree to participate in all reasonable promoted activities in relation to this promotion as requested by the Promoter and its agents.  
  1. As a condition of accepting the prize, the winner (and his/her companion(s), if applicable) may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.   
  1. If in connection with the Promotion you send any content (such as photographs, recordings or images of yourself or other people) and/or Giveaway entries and accompanying material (together “Content”) to the Promoter, or if such Content is created by the Promoter in the course of the Promotion, Irish Distillers may use such Content for publicity and promotional purposes. 
  1. All Content submitted to the Promoter will become the property of Irish Distillers on receipt and will not be returned. By submitting Content, you agree to: 
  1. assign to Irish Distillers all your intellectual property rights; and 
  1. waive all moral rights, in and to that Content which you may now or at any time in the future be entitled under applicable intellectual property law in force anywhere in the world. 
  1. You agree that the Promoter may, but is not required to, make Content available on its website and any other media, and in connection with any publicity of the Promotion. The Promoter may use, display, publish, transmit, copy, edit, alter, store, re-format and/or licence Content for its own purposes. 
  1. To the extent that the assignment of intellectual property right above at clause 28 is ineffective for any reason whatsoever, you hereby grant a perpetual, irrevocable, sub-licensable, royalty-free, worldwide licence to the Promoter to use your Content for marketing and publicity purposes. If required you shall sign any documents or do any other things necessary to give effect to this licence.   
  1. If you send the Promoter any ideas or suggestions, regardless of the topic, the Promoter will have no obligations with respect to such ideas or suggestions and may use them for any purpose whatsoever. 
  1. Where applicable, entries are subject to the Special Conditions. 
  1. Personal data will be collected and processed in accordance with the Promoter’s Privacy Policy. The Promoter may disclose personal data to third-party prize providers for Competition administration and prize fulfillment purposes, or in order to comply with any legal obligation. At any time you can exercise your rights of access, rectification, erasure, restriction, portability, objection by contacting us at idpr-privacy@pernod-ricard.com. You also have a right to lodge a complaint with the Data Protection Commission.  
  1. The Promoter supports responsible consumption and recommends that alcohol be enjoyed in moderation. 
  1. These Terms and Conditions shall be governed by the laws of the Republic of Ireland and the Irish courts shall have exclusive jurisdiction over any dispute or difference arising in connection with the Promotion or these Terms and Conditions. 
  1. An entry will not be accepted as a valid entry if (in the opinion of the Promoter) it: 
  1. encourages under-age drinking, has a strong or evident appeal to minors or features anyone who is, or looks, under 18 
  1. depicts or encourages irresponsible or offensive behaviour, excessive drinking or the misuse of alcohol 
  1. challenges or dares people to drink alcohol 
  1. associates drinking with engaging in any activity which requires a high degree of physical co-ordination, such as driving or playing sport 
  1. suggests that alcohol leads to success or can change your mood or environment 
  1. suggests that alcohol offers any therapeutic benefits or is necessary to relax 
  1. contains religious imagery 
  1. is offensive, anti-social, sexually provocative, discriminatory, exploitative or degrading 
  1. is misleading, deceptive, false, illegal or breaches anyone’s intellectual property right. 
  1. Neither Irish Distillers International Ltd nor its affiliates accept liability or damages for any injury, illness or damage caused to entrants including winners, by any participants in the Promotion, or the consequence of any actions taken by any participants in the Promotion or injury to the winners when receiving the Prize. Before being awarded the Prize, both winner and any Travelling Companions will be required to sign and return within the time stipulated by the Promoter, a full release and indemnity form in the Promoter’s form stating, among other things, that he/she has read and understood these official rules and regulations, grants all consents required by the Sponsor, accepts the prize as offered and releases the Sponsor from any and all liability of any kind arising out of the participation in this Promotion and receipt and/or use of the prize. 

Special Terms for Jameson Distillery Bow St. Christmas consumer competition: 

  • Entry is open to individuals who make a single transaction of €100 or more at the Bow Street Shop during the month of December. 
  • Participants must submit their sales receipt, which includes their full details, in-store on the date of purchase. 
  • The prize consists of a stay at a 5-star hotel in Dublin, which will be chosen and booked by Jameson Distillery Bow St. 
  • Closing date for entries is 31/12/2024. 
  • The winner will be selected at random from all eligible entries received. 
  • The winner will be notified by email within 2 weeks of the closing date. 
  • Prize must be redeemed by 30/06/2025. 
  • Booking dates for both the hotel stay and the Bow Street experience are subject to availability. 
  • Irish Distillers International/Jameson Distillery Bow St reserves the right to modify or cancel the competition at any time. 
  • This competition is not affiliated with or endorsed by any third-party entities. 

 

Special Terms for Midleton Distillery Experience Christmas consumer competition: 

  • Entry is open to individuals who make a single transaction of €100 or more at the Midleton Distillery Shop during the month of December. 
  • Participants must submit their sales receipt, which includes their full details, in-store on the date of purchase. 
  • The prize consists of a stay at the 5-star Castlemartyr Hotel which will be booked by Midleton Distillery Experience for a date chosen by the winner. 
  • Closing date for entries is 31/12/2024. 
  • The winner will be selected at random from all eligible entries received. 
  • The winner will be notified by email within 2 weeks of the closing date. 
  • Prize must be redeemed by 30/06/2025. 
  • Booking dates for both the hotel stay and the Midleton Distillery experience are subject to availability. 
  • Midleton Distillery Experience reserves the right to modify or cancel the competition at any time. 
  • This competition is supported by the Castlemartyr Resort Hotel.
